Federal Court Issues Key Decision on NGO Challenge to Use of Fluoride in Water

The Toxic Substances Control Act (TSCA) often seems like the forgotten federal environmental statute in that it gets less attention in the press and judicial decisions than statutes like the Clean Air Act, Clean Water Act, or the Comprehensive Environmental Response, Compensation, and Liability Act (CERCLA or Superfund). That said, a judge on the Northern District of California issued a high-profile TSCA decision worthy of some discussion.
The TSCA authorizes the Environmental Protection Agency (EPA) to prohibit a particular use of a chemical if it determines that chemical poses an unreasonable risk to human health or the environment. The lawsuit, Food & Water Watch Inc., et al. v. United States Environmental Protection Agency, was brought under Section 21 of the TSCA, which allows citizens to petition to regulate individual chemicals. The citizen petition in Food & Water Watch challenged the EPA’s rejection of a citizen petition demanding that it ban the addition of fluoride to drinking water.
In its decision, the court denied the EPA’s motion for a protective order by rejecting the argument that courts should be limited to reviewing information originally presented in the administrative proceeding giving rise to the suit.
The court’s decision hinged on a provision of the TSCA stating that, in any challenge, “the petitioner shall be provided an opportunity to have such petition considered by the court in a de novo proceeding.” 15 U.S.C. § 2620(b)(4)(B). The EPA argued in support of its motion that “such petition” should be interpreted as limiting the scope of review to evidence in the underlying administrative record, while plaintiffs argued that the phrase “de novo proceeding” requires a less restrictive interpretation.
In denying the EPA’s motion, the court specifically held that the phrase “de novo proceeding” indicates that Congress intended a broad scope of review because the word “proceeding” encompasses all regular activities of a lawsuit, including discovery beyond the administrative record. Because the purpose of the TSCA is to protect the public from chemicals that pose unreasonable risks to health and the environment, the court held that “[a] de novo proceeding in district court modeled after traditional trial-like proceedings would not conflict with the purpose of the TSCA, but would instead effectuate it.”
The court’s ruling guarantees that any trial of this matter will be far broader than what the EPA preferred. Given that the fluoridation of water in the U.S. is commonplace, we will keep an eye on how this case unfolds.

Learning from bad examples
Examples of bad PowerPoint presentations are ubiquitous – but I urge readers to critically consider this recent example. The PowerPoint presentation the anti-fluoride campaigner, Paul Connett, prepared for his recent presentation to a meeting in the NZ Parliament buildings. Fluoride Free NZ (FFNZ) has provided a link to Connett’s presentation – Prof Paul Connett Power Point Presentation to Parliament 22nd Feb 2018.
It has 155 slides for presentation with another 24 extra slides to be held in reserve if he had time. Just the sheer number of slides, let alone the extreme detail on individual slides, violates a basic presentation rule to start with.
Well, I say “prepared” but the recent Fluoride Free NZ newsletter describes it as “The Power Point presentation that Prof Connett showed” to the MPs meeting. I find that hard to believe as only three MPs turned up to the meeting. In such situations, a reasonable person gives up on a detailed presentation and resorts to having a chat with the people who did turn up.

I urge interested readers to download it and have a look. Critique it from the point of view of the advice given by David JP Phillips above. It really is a bad presentation and I don’t believe any objective person could have taken anything meaningful from it. Treat this as a learning exercise.
Mind you, these presentations are usually simply “singing to the choir” – presented to true believers. All indications are that the three MPs who attended that meeting can be described that way. Other MPs were probably well aware that Connett’s presentations given on his recent speaking tour had no relevance to their work – and probably most were aware of his bias and unreliability as a source of scientific information, anyway.
Second reading of fluoridation bill
Parliament will shortly undertake the second reading of the Health (Fluoridation of Drinking Water) Amendment Bill. It is currently 15th on the order paper. This bill does not deal with the science of fluoridation – parliament wisely leaves that to the experts who can advise them when necessary. The bill simply concerns the procedure for decision-making – specifically suggesting transferring the decision from councils to District Health Boards. The Parliamentary Health Committee has already consulted widely on this – and FFNZ and Paul Connett have had every opportunity to present their views. In fact, Paul Connett and other opponents of fluoridation gerrymandered the system to get much longer presentation times than other submitters. I guess they have plenty of experience of making submissions and know all the tricks.

Why can't you accept that people don't like to be forced to take medication and we are suspicious of authority. Can't you see the corruption in the world, the lying from weapons of mass destruction, the babies thrown out of cots by Iraqi forces in Kuwait?
You accuse everybody opposing fluoridation of bias or lying. You accuse us of making money out of it.
Was this man who realized he was wrong corrupt?

Toothaches can affect a child’s performance in class and engagement with school activities. Colorado children also miss numerous hours of school each year because of preventable cavities.
That's according to a report released by the Colorado Department of Public Health and Environment. The upside? The report shows a 14 percent decrease over 10 years in the number of kindergarteners who have had at least one cavity.
The number of third graders with at least one cavity dropped by 10 percent during that time.
Compared to a decade ago, 55 percent more children in the third grade have received dental sealants, which are used to prevent cavities.
Sealants can decrease cavities by 80 percent.
“We’ve made progress,” said Dr. Larry Wolk, executive director and chief medical officer at the department. “But too many Colorado children still suffer needlessly from the preventable pain of cavities.”
According to the report, students at low-income schools have higher rates of untreated tooth decay compared to children at other schools.
African American and Latino children are more likely to experience cavities and less likely to have access to dental care than white students.
Kids who receive early dental screening and four fluoride varnish applications before age 3 can reduce their risk of cavities by 16 percent. Parents are recommended to take their children to the dentist by their first birthday.
CDPHE also recommends community water fluoridation, a safe and cost-effective way for communities to prevent cavities for all residents, regardless of income, race/ethnicity or access to dental care.
Children who drink fluoridated water from an early age experience 40 percent fewer cavities over their lifespan.
Currently, 75 percent of Coloradans have access to fluoridated water.
“Expanding preventive oral health programs like Cavity Free at Three, school sealant programs and community water fluoridation will help all Colorado children thrive,” said Katya Mauritson, state dental director.

The question of whether or not residents want fluoride removed from their drinking water will stay off the ballot.
A motion to ask those voting in the October municipal election their position on the issue was defeated by Sarnia council in a 3-3 recorded tie vote Monday.
Councillor Bev MacDougall couldn’t support the motion.
“I must go with my gut that says this is a public health issue,” says MacDougall. “I am not a scientist. I’m here elected here to read my brains out, to exhaust myself on every matter that is put before me until I can hardly stand another discussion about it. But, I don’t believe that a plebiscite is a way to manage a public health issue.”
Councillor Dave Boushy felt asking the public would have been very helpful for the next council.
“It comes up every year and it seems like the motion to take it to the public, and say ‘what do you think?’, are you in favour or you aren’t, will serve the problem and it will not come up at city council anymore,” says Boushy. “Don’t underestimate the intellect of the people. They would listen to both sides and make up their mind. Either yes or no.”
Councillors Anne Marie Gillis, Mike Kelch and Andy Bruziewicz were absent Monday.
Sarnia council went on the record in 2013 supporting the removal of fluoride from our drinking water.
However, the 5-4 recorded vote didn’t change the outcome because legally four out of the six Lambton Area Water Supply System member municipalities had to vote against fluoridation to have it removed and other municipalities didn’t agree, so it remained.

Australia - Residents share their thoughts on fluoride in the Brogo-Bermagui water supply
ON TAP: Tyge and Miller, both 12, of Bermagui drink water from the public bubbler when they hang out at the Bermagui skate park, which is set to be fluoridated following a recent decision by Bega Valley Shire Council.
There are mixed opinions from those hooked up to the Brogo-Bermagui town water supply regarding Bega Valley Shire Council’s decision to add fluoride to the system.
On Wednesday, February 21, council voted to seek approval from the NSW Department of Health to add fluoride to the Tantawangalo-Kiah and Brogo-Bermagui town water supplies.
Fluoride has been added to the Bega-Tathra water supply system since 1963.
Although his property isn’t connected to town water, Bob Herdegen of Verona had no objection to fluoridating the water system because it would benefit the wider community.
“I lost a bunch of my teeth to decay when I was younger, so anything that protects against that happening to other people is welcome by me,” he said.
But Bermagui resident Frances Matters disagreed, saying people should have the right to decide what they put into their bodies.
As a mother, she was opposed to her daughter ingesting fluoridated water.
“She brushes her teeth everyday and her toothpaste already has fluoride in it, so I don’t think we need more than that,” Ms Matters said. ......................

Top Ten Arguments Against Water Fluoridation from Fluoride Action Network
- Fluoridation is a violation of the individual's right to informed consent to medication.
- Fluoride is not an essential nutrient. No biological process in animals or humans has been shown to depend on it. On the contrary, it is known that fluoride can interfere with many important biological processes and vital cellular constituents, such as enzymes and G-proteins. This makes fluoride potentially toxic even at low doses.
- Children in fluoridated countries are greatly over-exposed to fluoride. When fluoridation began in 1940s, 10% of children were expected to develop dental fluorosis (damage to the enamel involving discoloration and/or mottling) in its very mild form. Today, the prevalence in fluoridated countries is much higher—41% of all American children aged 12-15 are now impacted with some form of dental fluorosis (CDC, 2010), with over 10% in categories (mild, moderate and severe) that may need expensive treatment.
- The chemicals used to fluoridate water supplies are largely hazardous by-products of the fertilizer industry. These chemicals cannot be disposed of into the sea by international law, and have never been required to undergo randomized clinical trials for safety or effectiveness by any regulatory agency in the world. The U.S. FDA classifies fluoride as an "unapproved drug."
- There is mounting evidence that swallowing fluoride causes harm. Fluoride has been found to damage soft tissues (brain, kidneys, and endocrine system), as well as teeth (dental fluorosis) and bones (skeletal fluorosis). There are now 24 studies that show a relationship between fairly modest exposure to fluoride and reduced IQ in children. Two of these studies suggest that the threshold for damage may be reached at fluoride levels similar to those used in water fluoridation.
- Swallowing fluoride provides little or no benefit to the teeth. Even promoters of fluoridation agree that fluoride works topically (on the outer surface of the teeth), and not via some internal biological mechanism (CDC, 1999). A recent U.S. study found no relationship between the amount of fluoride a child ingested and level of tooth decay (Warren et al., 2009). Topical treatment in the form of fluoridated toothpaste is universally available, so it is a mistake to swallow fluoride and expose all the tissues of the body to its harmful effects.
- Human breast milk is very low in fluoride. Breast milk averages only 0.007 ppm F (NRC, 2006). Even in areas with high fluoride levels, nursing children receive only a small fraction of the mother's fluoride intake, ensuring that the sensitive brains and bodies of breast-fed infants are protected from the developmental effects of this toxin. In contrast, a bottle-fed baby in a fluoridated area (0.7-1.2 ppm F) gets up to 200 times more fluoride than a breast-fed baby, resulting in an increased risk of dental fluorosis and other adverse effects.
- Once fluoride is added to water, there is no way to control who gets the drug or how much is ingested. No medical follow-up or monitoring of fluoride levels in citizens' urine or bones is being carried-out by health agencies and so no record is being kept of adverse effects or daily or accumulated exposures.
- Certain subgroups are particularly affected by fluoridation. People vary considerably in their sensitivity to any toxic substance, including fluoride. Infants, the elderly, diabetics, those with poor nutrition (e.g. low calcium and low iodine), and those with kidney disease are especially vulnerable to specific adverse effects of fluoride. Black and Mexican-Americans have a higher prevalence of the more severe forms of dental fluorosis (see Table 23, CDC, 2005).
- Fluoridation discriminates against those with low incomes. People on low incomes are least able to afford avoidance measures (reverse osmosis or bottled water), or treatment of dental fluorosis (see Point 3) and other fluoride-related ailments (see Point 5).

Apparently, it is. People in New Zealand are worried about the constantly changing and updating information on fluoridation.
They believe, that despite the other bigger problems in the country, this can be easily solved.
The new wave of panic has appeared after the series of different researching were made on fluoridation.
One research from the USA suggests that water fluoridation is responsible for lower children’s IQ. Other study claims that fluoridation effects thyroid function, whatever it may be.
According to Professor Paul Connett, whose article 50 Reasons to Oppose Fluoridation provoke new wave of concerns among New Zealanders, there has never been randomized trial which can prove the safety of fluoridation.
Paper says that fluoride which is used in New Zealand is industrial chemical, and not natural. It is toxic, and often contains different heavy metals in it.
While dentists believe that there are benefits for teeth, Health Ministry has published data, according to which over 40 percent of children suffer from dental fluorosis.
Ministry does not recommend fluoride in tablets. Meanwhile, they continue to add fluoride in water. According to official calculation, 500 ml of water is equal to one tablet of fluoride.
Doctor John Colquhoun, an ex NZ Principal Dental Officer, even wrote official statement where he confesses that he has changed his mind about fluoride in the water and its benefits.
People in New Zealand believe that fluoridation of water must be stopped until it will not pass official random trials and its effectiveness will not be proved by specialists.

It has now disappeared but I switched to quick showers rather than chance it coming back.

The Irish Examiner previously published an excellent report on the increase in dementia in Ireland (‘Dementia tsunami looms’, Catherine Shanahan, June 25, 2015).
In this article, Dr Ronan Collins was quoted as saying: “I have seen the exponential growth of dementia in our clinical workload over the last 15 years, a true tsunami with the burden it imposes on increasing numbers of people and their families, and its cost both in terms of the lost social contribution of the person and through the economic cost of care needed.”

Shanahan also reported that the economic cost of dementia illness in the Republic of Ireland was estimated to be €1.7 billion in 2010.
Like Ireland, the USA has also seen an unprecedented increase in dementia in recent decades. Between 1999 and 2014, deaths rates from Alzheimer’s disease in the USA rose by more than 50 per cent.
The current cost of healthcare for dementia in the USA is US$236bn (€191.2bn). It is important to be aware that the USA and Ireland are two of the most fluoridated countries in the world, with in excess of 70 per cent of their populations provided with artificially fluoridated drinking water.
It is also important to note that in 2003, research published in the Journal of Neurology, Neurosurgery and Psychiatry found that lower brain acetylcholinesterase (AChE) activity was associated with cognitive impairment in adults, and that individuals with low AChE activity may have early Alzheimer’s disease changes in the brain.
Most people remain unaware that in 2006, the National Research Council of the National Academies in the USA reported that fluoride inhibits the activities of AChE, and warned of the possibilities that exposure to fluoride may act to increase the risk of developing Alzheimer’s disease.
In 2014, the National Academy of Sciences in India reported that exposure to fluoride in drinking water resulted in significant impairment of AChE with the maximum inhibition occurring in the brain.
Importantly, the fluoride levels in drinking water in this study were comparable to that found in artificially fluoridated water in the USA and Ireland. In addition, the study found that co-exposure to fluoride and the Chlorpyrifos, a previously widely used pesticide that was permitted to be used in the agricultural sector in Ireland until March 2016, resulted in synergistic toxicity or enhanced impairment of AChE activity.
More recently, in 2015 the journal Pathophysiology published the findings of another study, which found that drinking water containing recommended levels of fluoride in drinking water resulted in brain neurotoxicity, by causing severe neuronal histomorphological changes and impairing AChE activity in the brain. As with Chlorpyrifos, co-exposure to fluoride and aluminium was found to result in synergistic toxicity.
Based on these findings, one would consider that to reduce the burden of Alzheimer’s disease, it is imperative that public health authorities and the Irish Government stop adding fluoride to our drinking water supplies.

Australia - Dentists urge ‘big picture’ view of fluoride in shire water
Wednesday’s decision that council would be fluoridating the remainder of the shire’s public water supply met with heated debate both inside and outside of the council’s chambers.
There were loud disruptions in the chamber with Mayor Kristy McBain rising on several occasions to ask for respect from the public members. Then, only a few hours later, online forums lit up with support for the decision, but also some anger and consternation.
However, two dentists would like to see the heat taken out of the debate that has been raging in the local area for many years.
“I am neither anti-fluoride or pro-fluoride,” a South Coast dentist who did not wish to be named said.
“I agree with the scepticism around fluoride, and I agree with environmental controls. I favour the current evidence-based science.”
The man who has been practicing dentistry in the area since the early 1980s has been following the scientific developments carefully, looking at how fluoride is administered and its impacts on human health.
“The science supports the positive impacts on populations who consume fluoridated water from big water supplies,” he said. “Sydney and Melbourne is an example of this.”
He has also been following the debates and public conversations around fluoride, which also have a long history.
“There were conspiracy theories in the ‘50s that fluoridation was a communist plot,” he said.
The South Coast dentist claimed that the dissemination of misinformation fuels much of the debate.
“The anti-fluoride supporters aren’t necessarily wrong,” he said. “But there is a lot of misquoting and exaggeration of the scientific literature.”
Dentist Michael Cahill, who ran a practice in Bega for 27 years, said he supports the council’s decision as a positive step forward.
“I see it as very positive,” he said. “I don’t know what took them so long.”
In his time working in Bega, Dr Cahill witnessed the changes in shire residents’ dental health brought about by what he believes were changes in public water consumption.
“When I began working in the ‘80s, you would rarely see a cavity. In the mid to late ‘90s the incidences of cavities and extractions increased,” he said.
However, rather than fluoride being the issue, Dr Cahill suggested this rise was due to more residents not drinking town water as well as the increased consumption of high-sugar drinks.
He has also noticed an increase in cavities in his current practice with similar factors influencing this rise.
“More people are drinking bottled or filtered water, and many are consuming more soft drinks and sports drinks,” he said.
Dr Cahill said the best way to consume fluoride for good dental health was through the water supply.
“Toothpaste only penetrates the outer layer of the tooth. If fluoride is ingested, it is taken right up through the tooth structure. Putting fluoride in the water supply is the most effective way,” he said.
Dr Cahill has spent many years researching fluoride and its implications on human health. He believes council’s decision is part of broader improvements in public health that is good news for residents.
“People are getting healthier and living longer, and better dental health leads to better medical health.”
The South Coast dentist encouraged people to look at the “bigger picture”.
“This is a something that will protect everybody. It is about community-based health and lowering the costs of dental health to individuals and communities,” he said.
He also said there are more pressing issues regarding public health than fluoride.
“The rising incidence of diabetes and the effects of soft drinks on dental health are more pressing issues,” he said.
“We should be looking more closely at Coca-Cola Amatil [than council].”

Devon dentist reveals 'heartbreaking' horror stories of children's rotten teeth - and how they could have been avoided
"I've had to refer children under 18 months to have teeth removed under general anaesthetic - it makes me want to cry."
A Devon dentist has spoken publicly about the 'heartbreaking' amount of tooth decay in young children that she sees every day - and how it could all be avoided.
Vicki Jephcote, of Torrs Park Dental Practice in Ilfracombe, has had to refer babies under the age of 18 months to have teeth removed under general anaesthetic and seen children come to her in tears of pain with huge abscesses.

...............................Both Rudegair and Jamieson have stated that the morning of February 8, the city received more complaints and contacted the Department of Environmental Protection. They say that at that time, they believed the problem was probably coming from one of two of the industrial plants in the area of the reports.
That is when the city issued the “Do Not Drink Water” warning to what seemed to be the affected area (previous coverage)
That morning, upon inspecting the water flow, it was determined there was a malfunction of one of the valves. Uncertified field testing of the water showed elevated levels of fluoride. Staff at Barrett Flats also noticed that a pump that put the flow of fluoride into the system was not functioning, and all of the fluoride tanks were empty. They discovered three different malfunctions with the pump which allowed elevated amounts of fluoride into the system. At that time, the staff cut off the fluoride flow from both plants and began to flush the lines, while continuing to take field tests, according to Rudegeair.
Although the malfunctions were discovered on the morning of the February 8, city officials still aren’t certain exactly when it occurred. When asked, City Manager Tracy Jamieson said, “The staff would have noticed if the fluoride was gone on the seventh,” but noted that it was something that they would continue to investigate.............
